They include a binding arbitration provision and class action waiver (Section 21) and a limitation of liability (Section 19) that limit your rights and the amount you may recover. 1. Acceptance of Terms and Eligibility

These Terms of Use (the "Terms") form a binding agreement between you and The James Sanson Team operating under Real Broker LLC ("we," "us," "our," or the "Operator"). By accessing or using MaricopaRealEstateAgents.com or any page or subdomain (the "Site"), by submitting any form, by responding to information on the Site, or by otherwise contacting us through any channel listed on the Site, you represent that you have read, understood, and agree to these Terms in their entirety; that you are at least 18 years of age and legally able to enter a binding agreement; that your use of the Site violates no applicable law; that, if using the Site for an entity or another person, you have authority to bind them; and that you have read and agree to our Privacy Policy, incorporated by reference. If you do not agree, do not use the Site or contact us through it. Continued use after any modification constitutes acceptance of the modified Terms.

2. Identity of the Operator, Broker, and Licensees

The Site is operated by James Sanson, a licensed Arizona real estate professional, doing business as The James Sanson Team, and is affiliated with Real Broker LLC. The designated agent is James Sanson, REALTOR. The employing broker is Real Broker LLC. The state of licensure is Arizona, regulated by the Arizona Department of Real Estate (ADRE), azre.gov. The service area is the City of Maricopa in Pinal County, zip codes 85138 and 85139. The primary phone is 520-838-8037, and the primary email is sales@maricopahomesforsale.com.

James Sanson is a member of the National Association of REALTORS (NAR), the Arizona Association of REALTORS (AAR), and applicable local associations and is bound by the NAR Code of Ethics. The team includes other licensed associates, including David Hoos and David Ruiz, and unlicensed administrative staff, all of whom operate under the supervision of the designated broker at Real Broker LLC, consistent with ADRE rules. All licensed activity is performed by the responsible licensee identified on the Site or in transaction documents.

3. Nature of the Site and Services

The Site provides general informational content about buying and selling homes in the City of Maricopa, including neighborhood information, market context, agent profiles, and the brokerage services The James Sanson Team offers. The Site also provides forms through which you may request a conversation about your real estate needs and be matched with the team member best suited to help.

The services we may offer after an initial inquiry include traditional Arizona residential brokerage services, such as listing, marketing, showing, negotiating, and assisting with closing for both buyers and sellers. We are not, and do not represent ourselves to be, mortgage loan originators, foreclosure consultants, debt negotiators, credit counselors, attorneys, accountants, financial advisors, insurance producers, or title or escrow providers. Our services are limited to those a licensed Arizona brokerage may lawfully perform. The Site is operated solely for the Maricopa, Arizona, market and is not a solicitation in any jurisdiction in which we are not licensed.

4. Not Legal, Tax, or Financial Advice

The Site and any communication from us are for general informational purposes only. Nothing on the Site or in any conversation, email, text, voicemail, or other communication is legal advice, tax advice, financial or investment advice, mortgage or credit advice, bankruptcy advice, appraisal or valuation services, home inspection services, or title or escrow services. For legal questions, consult an attorney licensed in the relevant jurisdiction; for tax questions, consult a licensed CPA or qualified tax professional; for financial questions, consult a licensed financial advisor. We may identify such professionals as resources, but we are not affiliated with and do not warrant the services of any third-party professional.

5. Real Estate Brokerage Relationship; When Agency Begins

No brokerage relationship, agency relationship, fiduciary duty, or other legal relationship is created between you and us by your use of the Site, your reading of Site content, your submission of a form, your initial call, text, email, or video conversation with us, any preliminary discussion of your property or options, or any general informational guidance.

An Arizona real estate brokerage relationship is created only when both of the following occur: the parties enter into a written brokerage agreement using ADRE-compliant forms (typically a Residential Listing Agreement, Buyer-Broker Employment Agreement, or other AAR or Real Broker LLC-approved agreement), and that agreement is executed by both you and the authorized licensee. Until both conditions are met, your communications with us are informational only, non-binding, and at-will, and we do not owe you the fiduciary duties of an Arizona broker. Specific agency relationships, including any dual agency, are disclosed in writing, with the informed written consent of all parties, before the relationship begins.

6. Agent Matching and How We Route Your Inquiry

This Site connects you with the member of The James Sanson Team best suited to your needs. When you submit a form, we use the information you provide, such as whether you want to buy or sell and your preferred language, to route your inquiry to the right licensed professional: James Sanson for seller and listing inquiries, and David Hoos or David Ruiz for buyer inquiries. The following clarifications apply.

Matching is not a guarantee of representation. Being matched with a team member does not, by itself, create an agency relationship. Representation begins only under the conditions set forth in Section 5.

No promised outcome. We do not promise that any property will sell or be purchased at any specific price, in any specific time, or on any specific terms. Any value estimate, market analysis, or comparison is an estimate based on available data, not a guarantee.

You choose. You are never obligated to engage our services after an initial conversation, and there is no cost or obligation to be matched.

How are we compensated? Our compensation is disclosed to you in writing before services are provided. Where we would be paid from more than one side of a transaction, we obtain your informed written consent first. Compensation is documented in a signed brokerage agreement and on the closing settlement statement.

7. Fair Housing, Equal Opportunity, and Non-Discrimination

We comply with the federal Fair Housing Act (42 U.S.C. 3601 et seq.), the Arizona Fair Housing Act (A.R.S. 41-1491 et seq.), the Civil Rights Act of 1866, the Americans with Disabilities Act as applicable to housing, and all applicable state and local fair housing laws. We do not discriminate or steer in the marketing, sale, leasing, or financing of real estate on the basis of race, color, national origin, religion, sex (including gender identity and sexual orientation), familial status, disability, source of income where protected, age where protected, ancestry, or any other class protected by applicable law. Information presented about Maricopa neighborhoods is intended to help all clients make informed decisions, not to influence choice based on protected characteristics. We conduct transactions in accordance with the NAR Code of Ethics, Article 10.

If you believe you have experienced discrimination in connection with our services, you may file a complaint with HUD at hud.gov, with the Arizona Attorney General's Civil Rights Division, with ADRE, or with the local REALTOR association. Nothing in these Terms waives any right to file a fair housing complaint.

8. Compensation and NAR Settlement Disclosures

Following the implementation of the National Association of REALTORS settlement, the following apply to broker compensation in any transaction involving us. Compensation is always negotiable and is not set by law. The compensation we will receive is documented in a written agreement before services are provided. Buyers working with us are typically required to sign a written buyer-broker agreement before viewing a property listed by a third party, consistent with NAR settlement requirements and current AAR practice. Any seller concessions are documented in the contract or a separate signed acknowledgment, are not labeled as commissions in contract documents per AAR guidance, and require the written consent of the parties. If you have questions about how any compensation in a transaction is structured, ask before signing any agreement, and we will provide a written explanation in plain language.

9. Referral Fees, Joint Marketing, and Affiliated Business

The Real Estate Settlement Procedures Act (RESPA), Section 8 (12 U.S.C. § 2607), and Regulation X (12 CFR Part 1024) prohibit kickbacks, unearned referral fees, and fee-splitting in federally related mortgage transactions, and we comply with these requirements. We do not currently accept referral fees from lenders, title or escrow providers, inspectors, insurers, or contractors. We refer clients to third-party providers based on a good-faith assessment of fit, not on compensation. If our practice changes, you will receive a written disclosure before any referral, consistent with RESPA and ADRE rules. When we refer a client to another licensed broker outside our service area, any broker-to-broker referral fee is paid by the receiving broker from that broker's commission, not by you, and is disclosed in advance. We do not currently maintain affiliated business arrangements as defined in 12 CFR 1024.15; if this changes, a written disclosure will be provided.

10. Lead Source and Lead Origin; Affiliated Routing

This Site is owned and operated by The James Sanson Team at Real Broker LLC and serves as the intake hub for the team's affiliated Maricopa real estate sites, including MaricopaCashOffers.com, MaricopaShortSales.com, and MaricopaNewHomes.com. Forms submitted on this Site, and inquiries forwarded to this Site from those affiliated sites over a secure connection, are received by our team and routed to the appropriate licensed professional. We do not purchase, sell, exchange, or aggregate consumer lead data from third-party lead-generation services for the Site, and we do not resell your contact information to other real estate professionals, lenders, or marketers without your prior consent.

If our practices ever change to include third-party leads, we will update this section and the Privacy Policy, ensure third-party sources are TCPA-compliant with consent verification, disclose when your information was obtained from a third-party source, and honor any opt-out you previously provided. If you receive a communication from us that you cannot account for, contact sales@maricopahomesforsale.com, and we will investigate, identify the source, and honor any opt-out.

11. Lead Qualification and Authorized Representatives

We may use lead-qualification staff or services to contact new inquiries, verify interest, and route them to a licensed agent. If we do, any such representative contacting you on our behalf will identify the company they represent and will not falsely claim to be a licensed real estate agent unless they are one. They operate under the same consent you provided when you contacted us, in accordance with our TCPA compliance practices, and any opt-out you provide applies to all future communications from us. Activities requiring an Arizona real estate license are performed only by licensed members of our team supervised by our designated broker. 12. No Guarantees; Forward-Looking Information

Real estate transactions are subject to many factors beyond our control, including buyer and seller decisions, buyer financing, appraisals, market conditions, interest rates, property condition, title issues, liens, HOA matters, individual circumstances, regulatory changes, and third-party actions. Nothing on the Site or in any communication with us is a guarantee, warranty, promise, or assurance of any specific outcome, including that any property will sell or be purchased at any specific price, time, or terms, that any home value estimate or comparison will match an actual sale price or appraised value, that any specific buyer or seller will close, or that any specific result will occur. Past results and testimonials reflect specific past transactions and do not predict future results. Every situation is unique. Forward-looking statements reflect our good-faith opinion at the time written and are subject to change without notice.

13. Contact Forms; Telephone, Text, and Email Consent (TCPA)

When you submit any form on the Site, or when you call, text, or email us, you expressly consent to receive communications from MaricopaRealEstateAgents.com and The James Sanson Team at Real Broker LLC, including the team member matched to your inquiry (James Sanson, David Hoos, or David Ruiz), and from our authorized representatives and service providers, at the telephone numbers, text-capable numbers, and email addresses you provide. This consent authorizes communications sent via automated telephone dialing systems, artificial or prerecorded voice messages, and SMS text platforms, consistent with the federal Telephone Consumer Protection Act (47 U.S.C. § 227), FCC rules (47 CFR § 64.1200), and applicable state Mini-TCPA laws.

Your consent to receive communications is not a condition of any purchase, sale, or other transaction. You may withdraw consent at any time using the methods in Section 14 (SMS) and Section 15 (email); for voice calls, tell us during any call or email sales@maricopahomesforsale.com. You represent that any number or address you provide is yours or that you are authorized to receive communications there, and you agree to notify us if your contact information changes.

14. SMS Program Details and A2P 10DLC

Our SMS communications are sent through carrier-registered Application-to-Person (A2P) 10DLC-compliant channels. The program covers messages related to your real estate inquiry, including responses, scheduling, status updates, and follow-up. Message frequency varies, and we do not send unsolicited promotional broadcasts. Standard message and data rates from your carrier may apply. Reply STOP to any message to unsubscribe and HELP for help. We attempt to send messages only between 8:00 a.m. and 8:00 p.m. at the recipient's local time, consistent with TCPA and state Mini-TCPA requirements, and we scrub against the federal Do Not Call Registry and applicable state lists before any marketing SMS messages are sent. We retain SMS consent records for the period required by law. Your consent applies only to communications from The James Sanson Team and its authorized representatives. Nothing in this program waives your rights under the TCPA or applicable state law.

15. Email and CAN-SPAM Compliance

If you provide your email and consent, we may send informational and marketing emails about real estate topics and our services. Our email complies with the federal CAN-SPAM Act (15 U.S.C. 7701 et seq.) and applicable state law: our emails identify the sender as The James Sanson Team at Real Broker LLC, use accurate subject lines and headers, include our physical mailing address, and include a working unsubscribe link processed within ten business days. You may also unsubscribe by emailing sales@maricopahomesforsale.com with UNSUBSCRIBE in the subject line.

16. Call Recording and Monitoring

Arizona is a one-party-consent state for recording telephone conversations (A.R.S. 13-3005). Many other states require all-party consent. Calls between you and us are not routinely recorded, but we reserve the right to record for quality assurance, training, dispute resolution, and compliance. If we record, you may be asked to consent at the start of the call, and if you do not consent, the call will not be recorded. Recordings are treated as confidential, may be made available to you on written request, subject to redaction, and are retained per our records schedule and ADRE requirements. Our primary number, 520-838-8037, is a voice line that does not receive text messages. Third-party communication platforms may record or transcribe communications as part of normal operation, as disclosed in our Privacy Policy.

17. Artificial Intelligence and Automated Decision-Making

We may use artificial intelligence and automated tools in our operations, such as drafting initial responses (reviewed by a human before sending), generating informational content, scheduling, market reporting, and the scoring and routing of inquiries to the right team member. Consistent with the California ADMT regulations effective January 1, 2026, the Colorado AI Act, and similar laws, we do not use AI or automated decision-making to make final decisions that significantly affect you, including whether to accept you as a client, the price at which a property is listed or sold, or the terms of any transaction. All material decisions are made by a licensed human professional. If you believe an automated tool produced an incorrect result that affects you, you may request a human review by contacting sales@maricopahomesforsale.com, and we will respond within 10 business days. Some Site content may be generated in part by AI and reviewed by our team.

18. Testimonials, Endorsements, and Past Results

Testimonials, reviews, and endorsements on the Site comply with the FTC Endorsement Guides (16 CFR Part 255). All testimonials reflect genuine experiences of past clients; we do not fabricate or distort them. Any material connection between a person providing a testimonial and us is disclosed clearly near the testimonial. Testimonials reflect specific past experiences and are not necessarily representative of typical results; your results may differ. We do not buy, sell, exchange, or solicit fake reviews, and we do not use AI to generate fake testimonials. If we discover an inauthentic testimonial, we remove it. Past results do not warrant or predict future results.

19. Disclaimers and Limitation of Liability

SITE PROVIDED AS-IS. THE SITE, ALL SITE CONTENT, AND ALL COMMUNICATIONS FROM US PRIOR TO A SIGNED BROKERAGE AGREEMENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, AND THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

NO PROFESSIONAL ADVICE. NOTHING ON THE SITE OR IN ANY PRE-ENGAGEMENT COMMUNICATION IS LEGAL, TAX, FINANCIAL, MORTGAGE, CREDIT, OR INVESTMENT ADVICE, AND YOU AGREE NOT TO RELY ON IT AS A SUBSTITUTE FOR PROFESSIONAL ADVICE.

LIMITATION OF LIABILITY. TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE OPERATOR, REAL BROKER LLC, JAMES SANSON INDIVIDUALLY, OR THEIR OWNERS, OFFICERS, MEMBERS, EMPLOYEES, AGENTS, AFFILIATES, OR CONTRACTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SITE OR ANY PRE-ENGAGEMENT INTERACTION, EVEN IF ADVISED OF THE POSSIBILITY.

LIABILITY CAP. EXCEPT AS REQUIRED BY ARIZONA REAL ESTATE LAW, ADRE RULES, OR OTHER NON-WAIVABLE LAW, OUR TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS ARISING FROM THE SITE OR PRE-ENGAGEMENT COMMUNICATIONS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). THIS CAP DOES NOT APPLY TO LIABILITY UNDER A SIGNED BROKERAGE AGREEMENT, WHICH IS GOVERNED BY THAT AGREEMENT AND ADRE RULES.

NON-WAIVABLE RIGHTS PRESERVED. To the extent any exclusion or limitation is unenforceable in your jurisdiction, it applies to the maximum extent permitted by law. Nothing in these Terms limits liability that cannot lawfully be limited, including for fraud, willful misconduct, or gross negligence. Your rights under Arizona real estate law, ADRE rules, the NAR Code of Ethics process, the Fair Housing Act, the TCPA and state Mini-TCPA laws, privacy laws, and consumer protection laws are not waived.

RELEASE. To the fullest extent permitted by law, you release the Operator, Real Broker LLC, James Sanson individually, and their affiliates, members, employees, agents, and contractors from all claims, demands, and damages of every kind, known and unknown, arising out of or related to your use of the Site, any information accessed through it, or any interaction with a third party arising from your use of the Site. You knowingly waive the protections of California Civil Code Section 1542, and any similar law in any jurisdiction, which provides: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her would have materially affected his or her settlement with the debtor or released party." This release does not apply to liability under a signed brokerage agreement or to any right that cannot lawfully be waived.

20. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless The James Sanson Team, Real Broker LLC, James Sanson individually, and their owners, officers, members, employees, agents, contractors, affiliates, and licensors from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Site; your breach of these Terms; your violation of any law or regulation; your violation of any third-party right; any information you submit that is inaccurate, false, or misleading; any misrepresentation you make; your provision of contact information for any person other than yourself without authorization; or any unauthorized use of the Site by you. We may assume the exclusive defense of any matter subject to indemnification, and you agree to cooperate.

21. Binding Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES DISPUTES TO BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION AND LIMITS HOW YOU CAN SEEK RELIEF.

Informal resolution first. Before initiating any formal proceeding, you agree to contact us at sales@maricopahomesforsale.com with a written description of the dispute and the relief sought, and to attempt in good faith to resolve it for at least sixty days. This is a condition precedent to arbitration or litigation.

Binding arbitration. Any dispute arising out of or relating to these Terms, the Site, or any pre-engagement communication that is not resolved informally will be resolved by final and binding arbitration administered by JAMS under its applicable rules. The arbitration will be held in Pinal County, Arizona, at another agreed location, or by videoconference at the consumer's election. The award may be entered as a judgment in any court of competent jurisdiction.

Class action waiver. All disputes will be brought only in your or our individual capacity, not as a plaintiff or class member in any class, collective, or representative proceeding. No arbitrator or court may consolidate claims or award class-wide relief.

Carve-outs. Either party may bring a qualifying claim in small claims court or seek injunctive relief to protect intellectual property or prevent irreparable harm. Nothing here prevents you from filing a complaint with ADRE, NAR, HUD, the FTC, the CFPB, a state attorney general, or any regulator with jurisdiction.

Right to opt out. You may opt out of this arbitration and class-action-waiver section by emailing sales@maricopahomesforsale.com within thirty days after first accepting these Terms, with the subject line "Arbitration Opt-Out" and your full legal name and the email used in any prior Site contact. The rest of the Terms still apply. This section survives termination.

22. Wire Fraud Warning

Real estate wire fraud is a serious and growing problem. Criminals impersonate real estate professionals, title companies, escrow officers, and lenders to redirect closing funds. We will never email or text you wire instructions, and we will never change wire instructions at the last minute. If you receive any message purporting to be from us, a title company, or a lender that contains or changes wire instructions, do not act on it; call the sender at a number you have independently verified. When in doubt, call us at 520-838-8037 and call your title company at the number on their official website. Report suspected wire fraud to the FBI's Internet Crime Complaint Center at ic3.gov, to your bank, and to local law enforcement. The James Sanson Team does not handle, hold, or process client funds; closing funds are handled by licensed Arizona title and escrow companies.

23. User Submissions and Content

When you submit a form or message to us ("User Submissions"), you grant us a non-exclusive, royalty-free, worldwide license to use, store, process, and reproduce the submission to respond to your inquiry, provide services, comply with our legal obligations, defend against claims, and maintain business records consistent with ADRE record-retention requirements. You represent that your submissions are accurate, that you have the right to provide the information, that they do not infringe any third-party rights, and that any contact information for a person other than yourself was provided with that person's authorization. Do not include confidential or privileged information in a submission; by submitting, you acknowledge that it is not confidential and creates no fiduciary or agency relationship by itself. We may refuse, remove, or decline to act on any submission at our discretion.

24. Intellectual Property; License to Use the Site

The Site, including all text, graphics, layouts, designs, images, code, schema, metadata, and other content (the "Site Content"), is owned by us or our licensors and is protected by United States and international intellectual property laws. Subject to your compliance with these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to access the Site for your personal, non-commercial use. You may not copy, reproduce, distribute, publish, sell, or commercially exploit Site Content; use any robot, scraper, or data-mining tool except general-purpose search indexing consistent with our robots.txt; frame or mirror the Site; remove proprietary notices; use Site Content to train any AI or machine-learning model except where required by law; or aggregate or republish Site Content as part of any competing service. Some Site Content may be licensed from third parties (stock photography, MLS feeds, manufacturer logos) and remains the property of those third parties. "Real Broker" and the Real Broker logo are trademarks of Real Broker LLC. "REALTOR" is a registered collective membership mark of the National Association of REALTORS, used only by members.

25. Third-Party Links and Resources

The Site may link to third-party websites and resources, including listing portals, lender pages, HOA portals, school district sites, government agencies, and industry organizations, for convenience and information only. 26. Privacy and Data Handling

Our collection, use, and disclosure of personal information through the Site is governed by our Privacy Policy, incorporated by reference. By using the Site, you also agree to the Privacy Policy, which addresses the information we collect, how we use and share it, our analytics and advertising practices, our cross-site lead routing, your rights under state and other privacy laws, cookies and tracking, retention, security, and how to exercise your rights.

27. Prohibited Conduct

You agree not to use the Site or our communication channels to violate any law; submit false, misleading, or fraudulent information; impersonate any person or misrepresent your affiliation; interfere with or gain unauthorized access to the Site or related systems; transmit any virus, malware, or harmful code; send unsolicited commercial communications; engage in conduct that is harmful, abusive, harassing, defamatory, obscene, or invasive of privacy; discriminate against any person in violation of fair housing or other law; scrape or harvest data for any commercial purpose, including training competitive services or AI models; submit contact information for any person other than yourself without authorization; or use the Site to identify a buyer, seller, property, or other party and then complete a transaction independently in order to circumvent any compensation owed to us under a signed agreement. We may investigate suspected violations and cooperate with law enforcement.

28. Governing Law and Venue

These Terms and any non-contractual obligations are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. The Federal Arbitration Act governs the interpretation and enforcement of Section 21. For any matter not subject to arbitration, the exclusive jurisdiction and venue is the state and federal courts in Pinal County, Arizona, and each party consents to that jurisdiction and venue. Regulatory complaints may be filed in the venue specified by the relevant agency.

Time to bring a claim. To the fullest extent permitted by law, any cause of action arising out of or related to the Site or any pre-engagement communication must be commenced within one year after the cause of action accrues. After one year, the claim is permanently barred. This limitation does not apply to claims arising under a signed brokerage agreement or to any right that cannot lawfully be shortened.

29. DMCA Copyright Policy

We respect the intellectual property rights of others. If you believe material on the Site infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act (17 U.S.C. 512(c)) that includes a signature of a person authorized to act for the copyright owner; identification of the copyrighted work; identification of the allegedly infringing material and its location; your contact information; a statement of good-faith belief that the use is not authorized; and a statement under penalty of perjury that the notice is accurate and you are authorized to act. Submit notices to sales@maricopahomesforsale.com with the subject line "DMCA Notice." We respond to valid notices consistent with 17 U.S.C. 512 and may terminate repeat infringers.

30. Force Majeure

We will not be liable for any failure or delay in performing an obligation under these Terms caused by events outside our reasonable control, including acts of God, natural disasters, fires, floods, earthquakes, pandemics, public health emergencies, war, terrorism, civil unrest, government action, telecommunications or internet failures, electrical outages, denial-of-service attacks, or vendor or software outages.

31. Severability and Entire Agreement

If any provision of these Terms is held invalid or unenforceable, it will be modified to the minimum extent necessary to make it enforceable or, if not possible, severed, and the remaining provisions continue in full force. If Section 21 is held unenforceable in whole or part, the remainder of Section 21 is enforced to the maximum extent permitted and the carve-outs remain available. These Terms, together with the Privacy Policy and any signed brokerage agreement, constitute the entire agreement between you and us on this subject and supersede all prior understandings. To the extent of any conflict, a signed brokerage agreement controls for matters within its scope. No waiver is effective unless in writing signed by us, and our failure to enforce any provision is not a waiver.

Survival. All provisions of these Terms that by their nature should survive termination or your discontinued use of the Site will survive, including the disclaimers, limitation of liability, release, indemnification, arbitration and class action waiver, intellectual property provisions, time-to-bring-a-claim limitation, and governing law.

32. Modifications to These Terms

We may modify these Terms at any time by posting the modified version and updating the "Last updated" date. Modifications are effective when posted unless we provide a specific effective date. For material modifications, we may also provide additional notice through the Site or by email. Your continued use of the Site after modifications are posted constitutes acceptance. If you do not agree, stop using the Site.

33. ADRE Complaint Process

If you have a complaint about the conduct of James Sanson, Real Broker LLC, or any associated licensee in connection with Arizona brokerage services, you may file a complaint with the Arizona Department of Real Estate, which reviews alleged violations of Arizona real estate law (A.R.S. Title 32, Chapter 20) and ADRE rules (A.A.C. Title 4, Chapter 28). For procedures and forms, visit azre.gov. Nothing in these Terms, including Section 21, prevents you from filing an ADRE complaint.

34. NAR Code of Ethics and Ethics Complaints

James Sanson is a REALTOR bound by the NAR Code of Ethics and Standards of Practice, which governs client relationships, advertising, dealings with the public, fair housing, and relations with other REALTORS. If you believe a REALTOR has violated the Code of Ethics, you may file a complaint with the local REALTOR association having jurisdiction over the REALTOR's primary place of business; procedures are described at nar.realtor. Nothing in these Terms, including Section 21, prevents you from filing an ethics complaint.

35. Accessibility

We design the Site with accessibility in mind and aim for substantial conformance with the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA, and we are mindful of the Americans with Disabilities Act and applicable state accessibility laws.
